A Medicare Set-Aside (MSA) is a financial agreement that allocates a portion of a Workers’ Compensation settlement to pay for future medical services related to the Workers’ Compensation injury, illness, or disease. These funds must be depleted before Medicare will pay for treatment related to the Workers’ Compensation injury, illness, or disease. An MSA protects Medicare's interest, as well as the injured party and their legal representative.
A Medical Cost Projection (MCP) consists of funds allocated for future medical expenses, regardless of whether they would be covered or not by Medicare. An MCP assists in the overall view of the value of a claim.
Although not every injury claim will need an MSA or MCP, it is highly recommended to accurately determine future medical needs of the injured party, as well as protecting not only Medicare's interest, but also the interest of the injured party and their legal representative.
